Circuit Civil cases are non-criminal cases in which individuals or businesses sue for damages exceeding $50,000. Cases involving claims of $50,000 or less are under the jurisdiction of the County Civil Courts.

Examples of Circuit Civil lawsuits include declaratory judgments, eminent domain, petitions, quiet title, and other civil actions.

Common Civil Terms & Instructions

The Motion for Default and proposed default must be filed through the e-portal. A non-military affidavit must be filed for each of the defendants before the default can be issued.

If an answer is filed after the Motion for Default, but before the default is issued by the Clerk, the default will be denied (even if after the 20-day deadline), the requestor would then have the option of filing a Motion for Judicial Default with the Clerk and sending a copy of the Motion and a proposed Order for Judicial Default directly to the judge.

Edna Lopez

Circuit Civil Manager

Edna has been with the Clerk’s office since 2013. She first began working as a Record Clerk in Family Relations before transferring to the Juvenile Department where she became the manager in January 2017. As the Juvenile Manager, she is responsible for managing the daily operations of the department and ensuring all state guidelines are being met. Edna has a bachelor’s degree in business administration and has taken courses towards her MBA. Edna is also an adjunct instructor at Indian River State College where she assists high school students in a college-readiness program called TRIO.
